ANIMALS/DOGS: Provides for kennel licenses for dog breeders
1 AN ACT
2 To amend and reenact R.S. 3:2772(B) and to enact R.S. 3:2772(G), (H), and (I), relative to
3 kennel licenses for dog breeders; to provide for license fees; to provide for penalties;
4 and to provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 3:2772(B) is hereby amended and reenacted and R.S. 3:2772 (G),
7 (H), and (I) are hereby enacted to read as follows:
8 §2772. Dog, cat, and kennel licenses fee and certificate; records

10 B. The governing body of each municipality or parish may, by ordinance, fix
11 the sum to be paid annually for the dog or cat license fee, which sum shall not be
12 more than eight ten dollars for each spayed or neutered dog or cat and not more than
13 sixteen twenty dollars for each unspayed or unneutered dog or cat. However,
14 notwithstanding any provisions to the contrary, the governing body of any
15 municipality or parish with a population in excess of four hundred seventy-five
16 thousand persons may, by ordinance, fix the sum to be paid annually for the dog or
17 cat license fee, which sum shall not be more than eight ten dollars for each spayed
18 or neutered dog or cat and not more than sixteen twenty dollars for each unspayed
19 or unneutered dog or cat, and any such funds derived from said license fee shall be
20 dedicated solely for the capture, control, and housing of stray animals.

1 G. Any individual or business with five or more dogs and who breeds and
2 sells dogs retail, wholesale, or to the public is required to procure a kennel license
3 and pay a kennel license fee in lieu of the individual dog licenses and license fees
4 provided for herein. The governing body of each municipality or parish may, by
5 ordinance, fix the sum to be paid annually for the kennel license fee, which sum shall
6 not be more than:
7 (1) Fifteen dollars, if no more than five dogs over the age of six months are
8 harbored on the owner's premises at the time of the application.
9 (2) Twenty-five dollars, if more than five dogs but no more than ten dogs
10 over the age of six months are harbored on the owner's premises at the time of the
11 application.
12 (3) Thirty dollars, if more than ten dogs over the age of six months are
13 harbored on the owner's premises at the time of the application.
14 H. No individual or business that breeds, buys, or sells dogs retail,
15 wholesale, or to the public shall maintain more than seventy-five dogs over the age
16 of one year at any time for breeding purposes.
17 I. Any person who violates the provisions of this Section shall be guilty of
18 a misdemeanor and upon conviction shall be fined not more than five hundred
19 dollars or imprisoned for not more than six months, or both.

Abstract: Increases the dog and cat license fees, provides for the procurement of kennel licenses and fees for dog breeders, and provides for penalties.
Present law fixes the annual sum for license fees at not more than $8 for spayed or neutered dogs and cats and not more than $16 for unspayed or unneutered dogs or cats. Further provides that municipalities or parishes with populations over 475,000 shall dedicate the fees solely for the capture, control, and housing of stray animals.
Proposed law increases the license fees from not more than $8 to not more than $10 for spayed or neutered dogs and cats and from not more than $16 to not more than $20 for unspayed or unneutered dogs and cats; otherwise, retains present law.

Proposed law requires individuals or businesses with more than five dogs that breed and sell retail, wholesale, or to the public to procure kennel licenses and pay kennel license fees instead of individual dog licenses and fees. Kennel license fees for those dogs over the age of six months harbored on the owner's premises at the time of the application shall be $15 for not more than five dogs, $25 for five to 10 dogs, and $30 for more than 10 dogs.
Proposed law prohibits an individual or business that breeds, buys, or sells dogs from maintaining more than 75 dogs over the age of one year at any time for breeding purposes.
Proposed law provides that a violation of present law and proposed law subjects the violator to a penalty of a fine not to exceed $500 or imprisonment for not more than six months, or both.
